All of the Haitians in Springfield are there legally because they have Temporary Protected Status under the immigration laws. TPS is a legal status created by Congress in 1990, which allows the executive branch to declare that immigrants from certain distressed countries can stay in the US temporarily. One of the bedrock principles of immigration law is that Congress can do pretty much anything it wants in regard to giving the executive discretion to carry out immigration policies, and the TPS program is a very straightforward law of that type.

But of course any time somebody like Vance — that is, an authoritarian reactionary, aka a Republican — doesn’t like the way a law is being applied by the federal government, that means that application is “illegal,” meaning, again, undesirable from the perspective of right wing goons like him.

And needless to say there are more and more Federalist Society Nexus 6 models in the judiciary who will come up with whatever preposterous pseudo-legal theory is being fed to them by hack lawyers to vindicate the claim that what was understood to be perfectly legal until five seconds ago actually isn’t:

If Trump gets elected, Stephen Miller’s Einsatzgruppen will be tasked with, er, “evacuating” not just the 12 to 15 million people in this country without legal status, but millions of others who are here legally, though not “legally” in the eyes of the GOP, along with yet millions more whose legal status isn’t questionable under even the craziest right wing theories, but who just get caught up in the churn because they have the wrong sort of name or pigmentation or relatives or political opinions.

Speaking of which:

An Ohio sheriff instructed residents to keep a list of homes displaying campaign signs in support of the Democratic presidential nominee, Kamala Harris, and her running mate, Tim Walz, in remarks on social media that caused alarm.

Bruce D Zuchowski, the Republican sheriff of Portage county, posted the remarks on Friday to his personal and professional Facebook pages, warning that undocumented immigrants would arrive if Harris were elected over his party’s nominee, Donald Trump.

“When people ask me … What’s gonna happen if the Flip – Flopping, Laughing Hyena Wins??” Zuchowski wrote, referring to Harris. “I say … write down all the addresses of the people who had her signs in their yards!”

Referring to immigrants as “Illegal human ‘Locust’”, Zuchowski added: “We’ll already have the addresses of the their New families … who supported their arrival!”

In the same post, Zuchowski added screenshots from several Fox News stories claiming that the Biden administration’s immigration policies were fueling a “crime wave” and “destroying small towns”.

At least two commenters said they would be collecting the addresses of neighbors who publicly supported the Democratic ticket, reported the Portager, a local newspaper for the county.
