Jonathan Turley folks:

This kind of thing shouldn’t even be dignified with a response, but what the heck:

(1) This isn’t a criminal trial and the proceeding isn’t subject to evidentiary rules. Unlike in a formal trial, there’s no requirement that something that anybody who was paying attention saw Trump do in public every day for two straight months prior to January 6, and then most brazenly on that day itself, be “proved” by entering evidence into the record. ETA: As JimmyTwoTimes points out in comments, even if this were a valid objection in any way, the House managers provided copious documentation of Trump’s incitement of the riot.

(2) The decision whether Trump should be convicted by the Senate is purely political, and not legal in any relevant sense. Whether Trump is guilty of inciting a riot is not, in this context, a legal question at all, which is to say the answer isn’t determined by either formal legal definitions of what constitutes the crime of incitement, or constrained by First Amendment considerations, as it would be in a criminal trial, which again this isn’t, and isn’t supposed to be.

The only question here is whether what Trump did between November 3 and January 6, of which the events of the last day of that period were merely the culmination, was bad enough that he should be barred from holding federal office in the future.

Pettifogging nonsense about whether “evidence” is being entered into the “trial record” is just a way of obscuring the fact that you have to be a moral imbecile to think that is a difficult question to answer.

Do remember that dishonesty and cowardice always have to be paid for. Don’t imagine that for years on end you can make yourself the boot-licking propagandist of the Soviet régime, or any other régime, and then suddenly return to mental decency. Once a whore, always a whore.”*George Orwell, September 1, 1944

*My apologies to whores for comparing them to Jonathan Turley.

Damon Poeter in comments:

Trump DID NOTHING for TWO FUCKIN HOURS after the Capitol was invaded by a bloodthirsty terrorist MAGA mob that came directly from his own ‘Stop the Steal’ event where he told them to go ‘fight’ to overturn the election. He’s the goddamn Commander in Chief and he DID NOTHING while the US Congress was literally under attack. And it wasn’t like he had some other thing he was doing, like playing golf or checking Don Jr into rehab or reading My Pet Goat to Erik. He has NO EXCUSE for not using the powers of his office to stop a terrorist assault on the US government. And when he finally did do something, TWO HOURS after the Capitol was stormed and occupied, he called the terrorists ‘special’ and said he loved them. How is this alone – his absolute dereliction of duty in the face of a terrorist attack on Congress and VPOTUS – not impeachable in the eyes of 45 Republican Senators? It’s so utterly shameful where we are as a nation.
