Pondering the Prop 8 Litigation

I have a longer and more detailed piece up at the Prospect considering the various possible outcomes of Prop 8 litigation. The most likely “minimalist” outcome would certainly be preferable to a decision upholding Prop 8, but contrarian arguments that such a holding would actually be optimal fail to withstand any scrutiny.
