Jack Balkin, in a must-read post, provides another reason to be skeptical about Jon Chait’s claim that the 2004 election won’t be important. Balkin notes the potentially disastrous consequences of further entrenching the constitutional vision of the Bush Administration.

I don’t believe, as Balkin and Sanford Levinson recently argued in what is generally a terrific article, that we are currently in the midst of a constitutional revolution. But another 4 years of Bush might be the tipping point.
