As a practical matter, “originalism” actually means “interpreting legal texts in whatever way advances the political goals of the Republican party,” and that’s all it has ever meant. That also happens to be the mission statement of the Federalist Society, which has spent its entire existence promoting the virtues of originalism in a totally non-partisan way.
And it will probably not surprise you to learn that, even if one were to accept that the views of the framers on that question were dispositive, there isn’t a shred of historical evidence for Yoo’s claim. (Andrew Johnson was impeached nine months before the 1868 election).
The parallels here with Merrick Garland are not exactly subtle, but subtlety has never been a hallmark of this particular production.
