Missed my assessment of Scalia’s legacy because you only read blogs at work? It’s still online and repays repeated skimming. Some other takes:
- The “tradition” of presidents not being able to get nominations confirmed in an election year does not exist.
- Obviously, as Harry Reid says Obama should nominate someone, not because they will be confirmed but to start the political pressure campaign with an eye on both the November elections and the next Congress. Kelly Ayotte is one example of a Republican senator who needs to be hit with a barrage of ads on this.
