Grand juries not returning indictments is indeed very rare, but that’s partly because most prosecutors don’t proceed with cases when they’re not confident that they can get one. Obviously, the Trump DOJ is not going to show this kind of restraint, making the Fifth Amendment a relevant check on arbitrary power again.
