Alito retirement hijinks
In a bizarre story befitting of the bizarre times in which we live, NPR reported this morning that Sam Alito was retiring, only to withdraw the story thirty-seven minutes later.
FWIW I think that what’s going on here is that Alito is going to retire sometime in the next few weeks, but he decided to fuck with The Liberal Media this morning, especially since he is very likely the person who leaked the draft opinion of Dobbs in order to nail down Kavanaugh’s vote.
Alito’s dissent in Trump v. Barbara was unhinged even by his non-existent standards, and I doubt he will resist the both internal and external pressure to turn his retirement decision into a boost for the GOP in re the midterms. (I also more than suspect that Donald Trump will crudely bribe him to do so, as is the fashion now).
If he does retire, this makes it likely that the SCOTUS will have an 80-100 year stretch of having the majority of its members selected by Republican presidents, even though Republican presidents rarely get the most votes in presidential elections any more (It’s a Republic not a Democracy).
