Since paperwight argues convincingly that the Dayton Amendment would not have pre-empted tougher state laws, I think the Democratic Senators who voted against should be called out and held to account. So, here is a list of Democratic Senators For Usury:

I don’t want to be seen as making a “Tweedledum/Tweedledee” argument here. ThisĀ indefensible legislation is being pushed hard by a Republican Administration, and supported in virtual lockstep by Republicans in Congress. And on the other amendments, most of the Democrats from outside of Delaware voted the right way. (In fairness, I should probably note as well that the Joementum was on the right side of the Dayton Amendment vote too.) But to have the last Democratic presidential candidate, the Senate Minority Leader, and one of the party’s rising stars vote against a modest cap on interest rates is just a disgrace.
