Jack Smith is filing an 180-page dossier today, full of juicy details regarding exactly HOW Donald Trump tried to overthrow the government that one time (this is illegal). In any event, while the precise details of the crimes Smith is prosecuting are no doubt of both great legal and historical interest, the crimes themselves happened more or less out in the open, at least for all practical political purposes. Everybody saw what Trump did between election night 2020 and January 6, 2021, because again he largely did it in public view, while all serious and sober observers averted their eyes and assured everyone else not to trust the evidence of their senses.
The biggest failure of the Biden administration, by far, was the failure to prosecute Trump’s autogolpe immediately and ruthlessly, as if Trump were a common criminal, which of course is exactly what he is. That decision was Merrick Garland’s, but ultimately the failure to put someone other than a timid institutionalist at the head of the DOJ was and is Biden’s.
Assuming Harris wins, she needs to avoid the same mistake, despite all the roadblocks that John Roberts and his caporegimes have put in the way of applying the law to ex-presidents named Donald J. Trump (offer not good on prosecutions of other future ex-presidents; not valid in Idaho and Hawai’i; other terms and conditions may apply).
