5CA summarizes every Republican judge’s views about voting rights, if a touch less artfully than John Roberts might manage:
This statement from the 5th Circuit is bonkers but it perfectly encapsulates the GOP position on voting.
In order to stop any tiny number of potentially fraudulent votes, officials may block untold numbers of legitimate votes — up to an including throwing them out w/o challenge. pic.twitter.com/t92hFxpvzh— Cody Fenwick (@codytfenwick) October 19, 2020
The fact that the burdens on the right to vote are very real and protection of the integrity of elections is imaginary makes it even worse.
Although a lot of discussions around abuses of judicial power focus on judicial review, a lot of bad actions by reactionary judges don’t involve striking down statutes per se. There are a lot of ways judges acting in bad faith can do damage.
