Another Federal Judge Holds DOMA Unconstitutional

This time, it’s Barbara Jones, a Clinton appointee to the District Court. It’s based on a broader theory than last week’s 1CA ruling, and hence is less likely to stand up in its current form, but it’s not bad to have a strict scrutiny opinion* out there in case Kennedy decides to go in that direction.

*As a commenter notes, I was misled by an excerpt; reading more carefully, the heightened scrutiny is just a more explicit version of the rational-basis-with-teeth in the 1CA opinion. Apologies for the misleading inference!
