It's problematic enough that Elena Kagan seems to be considered the clear front-runner for a Supreme Court nomination. What's worse is that she's not the weakest candidate of the three.

I'd have to agree that "how dare you respond to our laws that give the police virtually unlimited discretion to detain people for the crime of not having a passport.
