FDR spent a whole state of the union bitching about the Schlecter Poultry decision, but he didn’t say the words, “Supreme Court” directly, so that doesn’t count, according to whatever arcane rules the other side is playing by.

If Robert doesn’t have the judicial temperment to keep his mouth shut on political matters, he shouldn’t be in his position. It casts doubt on his ability to be reasonable and fair when administration arguments are presented.

In otherwords, impeachment should be an option.

IIRC, Lincoln spent a good chunk of his first Inaugural criticizing Dred Scott and its fallout, with Justice Taney, who had just sworn him in, sitting right there.

I believe that the Chief Justice of the Supreme Court is only infallible when speaking ex cathedra on matters of Constitutional dogma.
